LAW ALERT:

DOL SEEKS

FIDUCIARY RULE DELAY

 

 

 

On Thursday, February 9, 2017, the U.S. Department of Labor ("DOL") submitted paperwork to the Office of Management and Budget (OMB) to commence regulatory review related to the fiduciary rule ("Rule").  Although the content of the paperwork submitted to the OMB is not yet public, it is reported that the DOL will propose a 180-day delay of the Rule's applicability date with 15 days to comment on the proposed delay. 

  

The DOL's action comes in response to an Executive Memorandum issued by President Trump on Friday, February 3rd, directing the DOL to "examine the Fiduciary Duty Rule" and "prepare an updated economic and legal analysis concerning the likely impact" of the Rule.  The DOL's action also comes on the heels of the federal court ruling in Dallas upholding the DOL's authority to issue the Rule and related exemptions.

  

Please note the potential delay is merely pending and will not be official until the notice and comment periods have passed.  We will continue to keep you posted as details on this news develop.
